The Biden administration believes that Israel has most likely violated international standards in failing to protect civilians in Gaza but has not found specific instances that would justify the withholding of military aid, the State Department told Congress on Friday. Even so, the report — which seemed at odds with itself in places — said the United States had no hard proof of Israeli violations. The report, mandated by President Biden, also makes a distinction between the general possibility that Israel has violated the law and any conclusions about specific incidents that would prove it. The conclusions are unrelated to Mr. Biden’s recent decision to delay the delivery to Israel of 3,500 bombs and his review of other weapons shipments. The president has said those actions were in response to Israel’s stated plans to invade the southern Gaza city of Rafah.

CNN —The Biden administration said Friday that it is “reasonable to assess” that US weapons have been used by Israeli forces in Gaza in ways that are “inconsistent” with international humanitarian law but stopped short of officially saying Israel violated the law. Although the report does not find Israel in violation of either of the terms of the memorandum, it is sharply critical of the toll of Israel’s military campaign. The findings of the report mark another stark moment in US-Israeli relations in the same week President Joe Biden threatened to restrict weapons transfers if Israel goes ahead with a major offensive in Rafah. The administration was required to make a determination on those two matters under a February national security memorandum, which Biden issued under pressure from Democratic lawmakers. That official said the report would be shared with the Israeli government.

CNN —A court in Iran has sentenced acclaimed movie director Mohammad Rasoulof to eight years in prison and flogging for national security crimes, his lawyer said on Wednesday. The writer-director’s latest work, “The Seed of the Sacred Fig” is due to premiere at the Cannes Film Festival in France next week. According to Paknia, some also alleged they were asked by officials to tell Rasoulof to withdraw the film from the festival. “Once again, the judiciary’s verdict against Mohammad Rasoulof proved that the law is only a playground for stubbornness and revenge in the legal system contaminated by government jurisprudence,” it said. “Independent and freedom-loving cinematographers condemn the invalid judgment of the judiciary against Mohammad Rasoulof and stand by him and all the artists who make fun of government censorship.”

In February of last year, President Biden changed the U.S. standard for cutting off weapons deliveries to foreign militaries that harm civilians during wartime. The independent Oversight Board that hears appeals about content decisions on Facebook and Instagram said Tuesday it would consider whether the pro-Palestinian phrase "from the river to the sea" violates the platforms' rules including their ban on hate speech. In each of the three cases, other Facebook users reported the phrase, saying it violated platform rules on hate speech, incitement or violent organizations. The users opposed to the phrase then appealed to the Oversight Board. One of the Facebook posts being reviewed by the Oversight Board received about 8 million views, the board said. In one of its most significant decisions, the Oversight Board in 2021 upheld the suspension of former President Donald Trump from Meta's platforms but ruled that it was inappropriate to make the ban indefinite.

A core demand over by the pro-Palestinian student groups at Columbia University was for the school to withdraw investment funds from what they describe as companies profiting from Israel’s war in Gaza. The group has described those companies as profiting “from Israeli apartheid, genocide, and military occupation of Palestine.” Israel denies accusations of genocide. Columbia now lists five areas where it refrains from investing: tobacco, private prison operations, thermal coal, Sudan and fossil fuels — all decisions made in the past decade. Columbia was also the first Ivy League university to divest from South Africa, and various other colleges followed suit. In 2015, Columbia became the first US university to divest from private prison companies after a student campaign raising concerns about human rights abuses.

Israel, Gaza and the Law on Starvation in War

On March 19, Volker Türk, the United Nations’ human rights chief, said in an official statement that Israel’s policies regarding aid in Gaza might amount to a war crime. “The extent of Israel’s continued restrictions on the entry of aid into Gaza, together with the manner in which it continues to conduct hostilities, may amount to the use of starvation as a method of war, which is a war crime,” he wrote. Using starvation of civilians as a weapon is a serious violation of international humanitarian law, and a war crime under the Rome Statute, the treaty of the International Criminal Court, or I.C.C. was preparing to issue arrest warrants against senior Israeli officials — including potentially over accusations that they prevented the delivery of aid to civilians in Gaza. (They also said they believed that the court was considering arrest warrants for Hamas leaders, which could be issued concurrently.)
